Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website and services provided by JOAN GIGS, the business name of Joann Vitto ("JOAN GIGS", "I", "we", "us" or "our"). By placing an order, making a payment, or otherwise using my services, you ("you", "Client") agree to be bound by these Terms.

01Agreement to terms

By accessing this website or engaging my services, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and that you have the authority to enter into this agreement. If you are using my services on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree, you must not use my services.

02My services

JOAN GIGS provides custom thumbnail design and related graphic design services on a per-order or package basis. Specific deliverables, quantities, and pricing are described on this website or agreed in writing for custom orders. I reserve the right to modify, add, or discontinue any service or feature at any time.

03Orders & payment

To begin a project, you place an order and provide the information I need to complete it (such as video titles, footage, branding, and references). Prices are listed in euros (EUR) and are due in full before work begins unless otherwise agreed in writing.

• Payments are processed securely by third-party payment providers (such as PayPal and Wise). I do not store your full card details.
• All fees are exclusive of any applicable taxes, currency-conversion fees, or transfer charges, which are your responsibility unless stated otherwise.
• I reserve the right to refuse or cancel any order at my discretion, in which case any payment for unfulfilled work will be refunded.

04Delivery & turnaround

I aim to deliver completed thumbnails within the turnaround time stated for your chosen package (for example, 24–48 hours for standard orders). Turnaround times begin once I have received full payment and all materials required to start the work. Delays caused by incomplete briefs, slow responses, or additional requests are not counted toward the stated turnaround. All deliverables are digital files supplied by electronic delivery; no physical product is shipped.

05Revisions

Unless stated otherwise for your package, I offer revisions to ensure you are satisfied with the final design. Revision requests should be reasonable and consistent with the original brief. Requests that substantially change the scope or direction of the project may be treated as a new order and charged accordingly.

06Intellectual property

Upon full payment, you receive ownership of, or a perpetual license to use, the final delivered thumbnail(s) for your own content and marketing. JOAN GIGS retains the right to display completed work in its portfolio, marketing, and social channels unless you request otherwise in writing.

You are responsible for ensuring that any materials you provide (images, footage, logos, fonts, or other assets) do not infringe the rights of any third party. I am not liable for any third-party stock assets or licensed materials that you instruct me to use.

07Client responsibilities

• Provide accurate, complete and lawful materials and instructions.
• Respond to questions and revision proofs in a timely manner.
• Ensure you have the rights to any content you supply.
• Use deliverables in compliance with the policies of the platforms on which you publish.

08Refunds & cancellations

Because my work is custom digital design, refunds are handled in accordance with my Refund & Cancellation Policy, which forms part of these Terms.

09Acceptable use

You agree not to use my services for any unlawful, infringing, deceptive, or harmful purpose. I may decline projects that promote hate, violence, illegal activity, or that I otherwise consider inappropriate, at my sole discretion.

10Disclaimers

My services are provided "as is" and "as available". While I design thumbnails with the goal of improving engagement, I do not guarantee any specific results, click-through rates, views, revenue, or platform outcomes, as these depend on factors outside my control. To the fullest extent permitted by law, I disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

11Limitation of liability

To the maximum extent permitted by law, JOAN GIGS and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. My total aggregate liability arising out of or relating to these Terms or my services shall not exceed the amount you paid for the specific order giving rise to the claim.

12Indemnification

You agree to indemnify and hold harmless JOAN GIGS and its owner from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of my services, your materials, or your breach of these Terms.

13Termination

I may suspend or terminate access to my services at any time if you breach these Terms or for any other lawful reason. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.

14Governing law

These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-law principles. You agree that any dispute will be resolved in the appropriate courts of the Philippines, and you consent to their jurisdiction.

15Changes to these terms

I may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Your continued use of my services after changes take effect constitutes acceptance of the revised Terms.
